So I just got a newish copy of the Robert Kahn Clarinet Trio, it was published in 2012 but it's a reprint and the copyright still seems to be 1905. Here's a link:

So since they didn't update the copyright by editing it or anything then it should be fair game to upload right?

Yes so long as this new reprint doesn't contain any forwards or other prose and, if so, you don't include that in your scans.
